PUBLIC HEARING
A public hearing was held by the Spalding County Board of Commissioners in their office in the Courthouse Annex, Thursday, August 24, 2000 beginning at 6:00 o’clock p.m. with Commissioners, Michael Kendall, Martha McDaniel, Merrill Massengale and Earle Childres present. Commissioner Johnie McDaniel was absent attending the ACCG Leadership Academy in Athens, GA and Chairman Kendall was also absent. Also present were County Manager Mike Ruffin, Community Development Director Michael Sabine, Zoning Attorney Newton Galloway and Executive Secretary Phyllis Doane.

1. Call to order – Vice Chairman Massengale called the meeting to order in the absence of Chairman Kendall and presided over the Public Hearing.
Special Exceptions and Text Amendments:
Application #00-42S: Lift from the table - Edward L. DoBek, Owner – Horton Homes of Griffin, Agent – 811 Shoal Creek Road – requesting a Special Exception to allow a Class A Manufactured Home in the AR-1 District. Upon motion by Commissioner Childres, seconded by Commissioner Martha McDaniel and unanimously approved Application was lifted from the table.
Ms. Laura Best gave her address as 30 Potato Creek Road, The Rock, GA and stated she was a sales person for Horton Homes. She said Mr. DoBek’s home burned April 3, 2000 and he wanted to replace it with a manufactured home. She presented pictures of the home that burned and also pictures of the manufactured home he intends to purchase to the Board of Commissioners. She said the home has a 5:12 roof pitch and a rock foundation around this home and is approximately 2,000 sq. ft. She said that they feel that this home will be an improvement to the area.
Mr. Edward DoBek gave his address as 811 Shoal Creek Road and stated he intended to purchase this manufactured home. He said that he purchased the home and property eight (8) years ago and lived there until the house burned down April 3, 2000. He said that he lost everything in the fire. He said at the last meeting there was some concerns about the area and what he was putting in. He said that 80% of the homes on this street cannot be seen from the road. He said one of the larger homes is having a double wide put in the front yard in front of about a $200,000 home. He said that this mobile home will be a greater improvement of what he had and will upscale the road he lives on. He also presented pictures to the Board.
Commissioner Childres asked Mr. DoBek why did he request that this application be tabled at the last public hearing. He said because of the concerns that were raised at the Board of Zoning Appeals meeting, he had the application tabled because he did not understand about the zoning procedures and sought some legal counsel from his employer, who provides legal counsel.
Motion made by Commissioner Massengale to approve Application #00-42S. There was no second to the motion and motion died.
Motion made by Commissioner Childres to deny Application #00-42S. Commissioner Martha McDaniel seconded the motion. The question was called and motion to deny passed by a vote of 2-1 with Commissioner Massengale voting against the motion.
Application #00-45S: Ira W. and Frances E. Bowen, Owners – Premier Housing Group, Inc., Agent – 440 Hickory Circle – requesting a Special Exception to allow a Class A Manufactured Home in the AR-1 District.
Mr. Tracy Cook gave his address as 81 Glenn Place, Thomaston, GA and stated he was the General Manager at Premier Housing and spoke on behalf of the Bowen’s. He presented a picture of the manufactured home the Bowen’s intend to purchase. He said that in this particular area there are seven (7) manufactured homes already existing and six (6) site built homes and two (2) under construction. He said the home would have a heat pump, 4:12 pitch roof and 1,774 sq. ft. He asked the Board to consider approval of this application.
Mr. William Bowen, the applicant, gave his address as 57 Fifth Street and stated he is buying the above described manufactured home. He said that he has already purchased the land. He said there is a mixture of homes in this area and he is just looking for a place to live. He said that he feels this would be an improvement to the neighborhood.
Mr. Charles E. Trott gave his address as 520 Hickory Circle and stated he was opposed to this application. He said that he lives two doors away from this proposed site. He said there is a new home in its final stages being built between his home and the proposed site. He said that there is a trailer right across the street which someone has abandoned and there are two others; however, there are nine (9) site built homes on the street. He said that he feels that his property and the surrounding area will be depreciated.
Mr. Scott Bennett gave his address as 142 Hickory Circle and stated he was opposed to this application. He said that he is a new resident and has built a new house and would like to see all new homes be stick built homes to protect his property and the neighborhood.
Upon motion by Commissioner Massengale, seconded by Commissioner Childres Application #00-45S was denied by a unanimous vote of 3-0.
Application #00-46S: Preferred Sites, LLC, Owner – TowerCom Atlanta, LLC, Agent – 645 Bucksnort Road - requesting a Special Exception to add additional height to an existing tower. Mr. Allen Richardson was present to address this application; however, the Board did not have any questions.
There was no one else who wished to address the Board on this application.
Upon motion by Commissioner Martha McDaniel, seconded by Commissioner Childres Application #00-46S was unanimously approved by a vote of 3-0.
Amendment to UDO #A-00-08: Appendix A. Subdivision Ordinance – Section 502: add provision for Subdivision Entrance Requirements.
There was no one present who wished to address this amendment.
Upon motion by Commissioner Martha McDaniel, seconded by Commissioner Childres UDO-A-00-08 was unanimously approved by a vote of 3-0. The Resolution will be incorporated into the minutes on second and final reading.
Amendment to UDO #A-00-17: Appendix A. Subdivision Ordinance – Section 410:C – Recording & Dedication – Surety for Maintenance and Repair.
There was no one present who wished to address this amendment.
Upon motion by Commissioner Martha McDaniel, seconded by Commissioner Childres UDO-A-00-17 was unanimously approved by a vote of 3-0. The Resolution will be incorporated into the minutes on second and final reading.
